Hrm 300 Week 1

Human Resource Management Overview Introduction Human resource management (HRM) has evolved into a huge industry in the business arena. The evolution and advancement of technology has created a global platform for HRM. The effect of globalization in many organizations has opened the door for HRM, and it is a crucial component for a successful business strategy and plan. This paper will define HRM, and discuss HRM’s primary function and role in an organization’s strategic plan. What is human resource management? HRM is comprised of the staffing, development, motivation, and maintenance functions. Each of these functions however is affected by external influences† (DeCenzo & Robbins, 2007, p. 50). In HRM, staffing involves strategic human resource planning, recruiting and selection. It is important to select the right people for your organization. Recruiting is critical because it can make or break your business. Training and development consists of equipping th e employees with the necessary skills and knowledge. Successful businesses have a vested interest in the employees.Inquiring about employee goals, family, strengths and weaknesses, and using that information to assist him or her in reaching their potential can improve productivity in your organization. For example, my company offers tuition reimbursement. That is an excellent benefit to take advantage of because I value education. I have a personal goal to obtain a MBA. Because my company is paying for my education, it serves as an incentive for me to continue working for the company and strive to move up the corporate ladder. In turn, my company reaps the benefit of the skills and knowledge achieved from the training and development. The maintenance aspect of HRM involves communication and safety and health. This portion of HRM is concerned with the well being of employees, and enhances the nature of the job and personal life of the employees (DeCenzo & Robbins, 2007). OSHA was implemented under the government to protect the employees in regards to his or her physical safety. The contract on which I work at the U. S.White House consist of several constructions projects that Some people have to wear steal toe boots, safety glasses and ear plugs in order to prevent possible injuries. This is mandated in areas that could be hazardous. What is the primary function of HRM? The primary function of HRM has changed drastically because of Federal and State laws, new requirements with employment practices, and involves hiring the right people. Because of the changing technology the primary function of HRM is recruiting people with higher skill sets.Organizations now need people with higher level degrees and certifications in the computer field. The reason for this mandate is because information systems are becoming more complex and ever changing. New recruits must be trained on new software programs. Employees have to be able to adapt and be critical thinkers in ord er to stay up-to-speed. In addition, employees have to be trained and specialize in various fields. What is the role of the HRM in an organization’s strategic plan? HRM has various roles in an organization’s strategic plan. HRM must therefore balance two primary responsibilities: assisting the organization in it strategic direction and representing and advocating for the organization’s employees† (DeCenzo & Robbins, 2007, p. 34). HRM has a vital role in an organization, and â€Å"must be forward thinking† (DeCenzo & Robbins, 2007, p. 34). HRM must work with management in order to accomplish the strategic plan. They must be in line with the company’s vision and mission statement in order to assist the organization. Determining ways to cut cost, but still maintain higher productivity is one way to help the business.HRM can also perform inspections throughout the organization to weed out weaknesses in operations or functions, and unprodu ctive employees (DeCenzo & Robbins, 2007). Making a few necessary adjustments by holding weekly meetings can make a big difference in implementing and monitoring the progress of the strategic plan in an organization. My company performs weekly productivity checks to keep the organization strong and fluent. We are required to report to the supervisor each week providing status on our tasks and progress, and share our ideas on how we can improve. Conclusion In conclusion, HRM is a crucial component in today’s business arena. Technology and globalization have broadened the scope of HRM. Information systems and global recruitment efforts increase the complexity of HRM. Throughout this paper, we have defined HRM, discussed its primary function, and determined how it impacts the strategic plans of companies all over the world. Reference DeCenzo, D. , & Robbins, S. Environmental Analysis of Dell Organization Essay

Dell’s external environment identifies all the current conditions and forces that affect its strategic options and define its competitive situation. It consists of three main sectors: the Remote Environment, the Industry Environment, and the Operating Environment. All of these environmental sectors affect the firm’s operations both on an international and domestic level. Remote Environment In recent years the computer hardware industry has experienced a slight decrease in profits. Most of this is due to the recent downturn in the economy and a decrease in consumer confidence and spending because of inflation. Many consumers hesitate to upgrade their computers. As a result, Dell must explore new markets and introduce attractive products at a lower-cost to attract its customers. The use of personal computers in international markets is growing rapidly. Dell Computer can take this opportunity as an advantage to provide lower cost computer for consumers. Since Dell has the equipment and capital they can produce higher quantities of workstations or servers at a low operating cost and then sell it a little above cost of goods to China, India, Vietnam and third world countries to increase their global market share. The internet market has been expanding and exploding across the globe. It has varied by market segment and already has been a big hit in the U.S. Dell knows that the way to globalize the company successfully is through e-business. Dell is gearing up in China. The key to its strategy is a locally designed PC called Su Ma (Speedy Horse) which it hopes will draw sales away from the homegrown powerhouse, Legend. Dell has already built a factory in Xiamen, which is on the southeastern coast of China in order to promote its next day delivery to 400 cities which is one of the company trade marks. As a result, Dells China market share has grown from near zero in 1998, to 4.4%. This runs counter to the general wisdom that Chinese consumers must feel and  touch a product before they buy. More business and more production facilities will be opened world wide to adopt the globalization system and the global demand in the next decade. Industry Environment Rivalry is high in the computer industry because there is a lot of competition among a number of market leaders, while there is lack of differentiation and low switching costs for customers. Barriers to entry are also high due to a large part of the market is controlled by the market leaders of the industry, in addition to high start up costs. The bargaining power of suppliers is also high because suppliers are few and there is a heavy reliance on them. The bargaining power of customers is also high because of the availability of many high quality computer companies, all products are perceived as similar and well as the ease of switching. The threat of substitutes is low because they are virtually non-existent. Furthermore, there is a high availability of supplementary products available. Dell Computer Corporation is more successful than its competitors because they have been able to cut out the middleman with its â€Å"Direct Marketing† strategy. Dell entered the computer industry at an opportune time with competitive prices and a production strategy which does not build units until units are ordered, which minimizes inventory and allows customers to customize their units. The direct sales model has helped in cutting down inventory costs and also reduces the lead time in serving customer order. The biggest entry barrier that Dell has to face when expanding into other areas of the technology industry is having customers gain the trust of company over the more popular veteran computer companies. Operating Environment Consumers view Dell as a quality brand at a good price. Some consumers find that Dell’s competitors may be a little more expensive but still offer a quality brand. Dell’s main competitors are IBM, Compaq, Hewlett-Packard and  Gateway. Dell’s competitors have all tried to replicate Dell’s direct marketing strategy. However Dell’s competitors were and still are unable to replicate Dell’s direct marketing success. Historically Compaq and IBM sold through resellers and distributors. When IBM and Compaq announced their new initiative to sell directly to their customers, they angered the resellers, who in turn promoted HP products. HP is able to fulfill the needs of customers who want to see and touch the computer before purchasing it, which is not possible in the direct marketing strategy. But HP’s growth is declining with this strategy and they have been unable to lure major accounts. Gateway has been somewhat successful in implementing the direct marketing strategy, but Gateway does not have a strong hold in the lucrative large customer accounts. Dell ranks high with customers because the company offers free technical support if needed. The purchasing process has changed for the consumers with Dell because all the ordering is done online which offers convenience to its customers and minimize inventory. The flow of materials from suppliers into Dell starts by the company putting in orders to factories that are based on two categories; product type and geography. When putting in orders for product type Dell wants to select the right factory that specializes or deals with a certain product. Geographic orders mainly focus on the where the order is coming from to minimize the transportation expense. Dell has superb relationships with their suppliers; they maintain those superb relationships, by ensuring that the suppliers win every time Dell wins. Dell will need to implement several changes in the next couple years to develop its system, improve customer service, reduce cost, and improve supplier control. Dell will lead the technology industry and be a good example to the competitors. More technology of software and hardware will be available in the futurw with less cost. Long Term Objectives Dell’s objective should be continue providing customers the most recent technologies at competitively lower prices, at lower costs and faster than  their competitors. This could be established in the long run as they: 1. Increase global market share by focusing on Asian markets. 2. Increased revenues by penetrating the Chinese market benefiting from low costs. 3. Continue expansion of server and storage products. 4. Continue to maintain the lowest costs in the industry 5. Establish global brand recognition. 6. Increase diversity in portfolio by expanding product offering and investing in a new industry within the technological sector. 7. Manufacture some of its supplies, decreasing reliance on suppliers. 8. Use the Internet to improve the efficiency of Dell’s procurement, manufacturing and distribution process and further expanding an already broad range of value-added services. References: Abraham, H. The Shakedown Business - Essay Example It does not have any connection in the country. The fact that the company’s officials bribe Mylofienko in order to get their telephone lines installed faster make them easy targets for other officials who are extortionists. Ukraine also permits payment of facilitation fee which Zhuk is keen to pay in order to get his company’s telephone lines installed. Additionally, the high business goals that Zhuk sets also make the company a target of extortion by the officials. Zhuk establishes the company so that he can change people’s lives. He pays the best salaries to his workers and ensures they have a comfortable life. Moreover, the company shows that it is willing to pay any official any amount of money so as to pursue business interests in the country. Customer Strategy Solution presumes bribing as the only way of succeeding in Ukraine. They want to have an advantage over other business rivals hence the dealings with officials who are corrupt. Question 2 Customer Str ategy Solution should not have used that mode of payment in order to get their telephone lines installed. By paying a bribe to Mylofienko, the company showed that it was willing to pay any official any amount of money so as to pursue business interests in the country. Customer Strategy Solution presumes bribing as the only way of succeeding in Ukraine. They want to have an advantage over other business rivals hence the dealings with officials who are corrupt. Question 2 Customer Strategy Solution should not have used that mode of payment in order to get their telephone lines installed. By paying a bribe to Mylofienko, the company showed that it was willing to pay any official any amount of money so as to pursue business interests in the country. Zhuk and Hnatyuk visited Mylofienko, a senior telecommunications manager, to acquire relevant information n costs associated with telephone lines installation. According to Mylofienko, renting a telephone line would cost the company ten hyrv nia monthly, and the rate of use would be 0.5 hyrvnia per single minute. The telecommunication company was willing to charge the company 100 hyrvnia. This amount was fair according to Zhuk and Hnatyuk. They were able to pay the stipulated amount as presented by Mylofienko. Mylofienko informed them that it will take a period of three years before the company’s telephone lines could be installed. He attributed this long wait to a huge number of orders placed by people and companies. The delay in installing the telephone lines would mean that the company’s project be slowed down or fail to be realized altogether. Hnatyuk’s thought of acquiring services from another, though more expensive company made Mylofienko decide to help them with the installation, but at a fee. He was to give exceptional treatment to their application. He was to be given $300 per line; he was also to install ten lines in the company’s office at a cost of $500 in a month’s time, and the installation was to begin the week that followed. The higher the amount demanded by the telecommunication company, the faster Customer Strategy Solution, would start its operations. For $3000, the company would start functioning in a month’s time. $5000 meant it would commence its operation the following week. Making fresh appointments, spending extra time getting wired and meeting new people posed a new challenge. These thought made the company decide to accept the terms of Mylofienko in exchange for the installation services. They demanded to get the telephone lines get installed in the shortest time possible. What followed was Hnatyuk’ giving Mylofienko the envelope containing some money and one copy of the contract between the two companies. The company had bribed Mylofienko. They should not have made their payment the way they did. The company should have followed the due process

Fiber optic is reliable with networking. I mean” how is it been Essay

Fiber optic is reliable with networking. I mean† how is it been secure† - Essay Example In a relatively short amount of time, a vast number of households and companies shifting from cable wires to this technological option. So just what makes this piece of technology so indispensable today? In a study from the Sans Institute Reading Room site, it says that fiber optic cables "can go an average of 62 miles versus 1.2 miles that copper can go before the signal needs to be regenerated or boosted."   (Witcher, â€Å"Option 1†¦Ã¢â‚¬ ) Fiber optic cables also do not conduct electricity, since they are not metallic, which makes them less interfered by radio frequencies, electromagnetic interferences, or even lightning. They are also smaller and lighter than copper wires, and are not affected by atmospheric conditions making them even more "installation-friendly" to areas that copper wires cannot go. With all these, plus the fact that fiber optic cables do not produce electrical radiation, fiber optics has been the choice solution for a better and a more secure means of communication by companies across the globe. However, it is not all good news. Through the years, research has proven that fiber optic cables can be easily tapped. One, which is the easiest, is called splicing. Splicing is done by an inserted apparatus intercepting a signal while it is currently transmitting data to an end party.   However, this method is easily detectable by most network security systems.  Another method of getting data from fiber optic cables is through splitters and couplers. This method is done by slightly  bending, crooking or putting a clamp on an optical fibers length so that light photons will leak into the tappers receiving device.   Lastly, there are the non-touch methods. The more advanced of these methods are able to derive the underlying optical signal by understanding the interactions between the fiber plant and the extra light added into it. Without any physical-layer optical signal protection,

Americanization Essay Example | Topics and Well Written Essays - 1250 words

Americanization - Essay Example Ellis further contributed to this definition by arguing that, despite Thomas Jefferson advocating for the end of slavery, he has many contradictions, which prove he indeed was for slavery and not its abolition. According to Joseph Ellis, Jefferson owned approximately 600 slaves, and his tobacco plantation relied entirely on slave workers. To add on to Jefferson’s definition, Ellis argues that, according to Jefferson, superiority came with skin color. The light skinned slaves had a more superior position than other slaves. Frederickson’s models of American Ethnic relations further compound on the need for one America without racial differences. He says: â€Å"group separatism emanates from cultural ethnocentric concerns about the standing and fate of a certain group† (Ellis, 457). Despite the difference, in skin color and physical appearance, the color of the blood is the same, the brain the same when expose to the same conditions like infrastructure and technolog y. Can Americanization be achieved with color still a factor? Racism vs. Americanization: Americanization, which is the dream of every American, with freedom and equality based on racial differences is not what is quite being experienced. This is shown by Thomas Jefferson in his notes on the state of Virginia. ... According to Sherman Alexie’s work, assimilation shows how one tries to adopt other people’s culture and the way of life in general in order to fit in a society. This is made hard by the external features that one possesses like color, texture of the hair and height depending on one's race. Marriage between people of different races is highlighted here and prejudice is very apparent despite one's efforts to assimilate into the other person’s culture. Despite how much one tries to fit into a foreign way of life especially where the difference is based on race, one still stands out because some external features are so obvious, and one cannot hide them. Sherman Alexie’s view on Americanization is that people are expected to assimilate the American culture despite their different externalities, hence robbing the immigrants of their originality. Therefore, Americanization is American based and for the Americans only. Looking at Americanization by Studs Terkelà ¢â‚¬â„¢s eyes, we find that even in the job sector racism is very much evident. Stephen Cruz’s story by Studs Terkel in Rereading America state that the American dream is not governed by hard work, opportunity and education, but by fear and power (365). How much a person can achieve, being racially different, will always be a setback which, as Cruz says, should be overcome for Americanization to take root. Americanization which comes with the American dream should pave the way for everyone living in America to have liberty and freedom from any form of discrimination wherever one is, be it at home, in politics, education or the job sector. Major reasons behind the United States'entry into World War I Essay

Major reasons behind the United States'entry into World War I - Essay Example As the US was supplying arms and financial assistance to the allies, Germany became poised to violate the terms with the US government to stop its submarine attacks. While the then German Chancellor Theobald von Bethman-Hollweg was against this decision fearing the US entry in to the war and the subsequent downfall of Germany, the German government however, decided to resume its attacks. President Wilson, thought shocked by the developments, hesitated to immediately declare war on Germany as he was not sure about the public support of his opinion. And in case the German attacks did not target US ships he decided to negotiate with the German government. But the submarine attacks by Germany destroyed several US ships, passengers and naval officials. Following this Wilson decided to arm American merchant ships with naval personal and equipment’s by exercising an executive order. Wilson also received a German telegram sent to officials in Mexico which was intercepted by the Britis h. This telegram sent by the German Foreign Minister promised assistance to Mexico to recover the territory that it had ceded to America during a previous war. In return it requested Mexican support for the war. This telegram along with the continued attacks by Germany on American merchant ships forced President Wilson to declare war against Germany which marked its entry in to World War

Problem identification Essay Example | Topics and Well Written Essays - 500 words

Problem identification - Essay Example , which is estimated to be at a record high and reflects the magnitude of health crisis that has befallen the average American citizen in present times (msnbc, 2010). One out of every three adults in the U.S. are either uninsured or underinsured (AAOS.org, 2010). Research suggests that this is one of the most crucial problems facing public policy makers. The people facing such problem are considered to be at a high health risk when faced with a serious illness, and may even face death due to delay in receiving primary care or prompt medical assistance (Hammaker & Tomlinson, 2010). Statistics suggest that there is a significant rise in the cost of health insurance in the current year, which is estimated to be about 9 per cent over the previous year (NYTimes, 2011). This is likely to have a negative impact on the public healthcare system, since most of the people depend upon company sponsored insurance. With the rise in healthcare insurance, coupled with weakening of the economy has led to loss of jobs, and hence rise in number of uninsured people. The poor and uninsured populations mostly depend on the public healthcare system which increases the financial demand on it, thus leading to uneven access to healthcare and poor clinical outcomes (Lundy, Janes, 2009). Currently access to healthcare is highly disparate across various socio-cultural groups. Such setbacks, act as a hindrance to the provision of good quality healthcare services, and restrict the performance of the sector (Williams, 2007). AAOS.org (2010). Case study - Essay Example One thing which is common among them is that they all love their jobs, even if they are apparently difficult to others. All the job profiles mentioned in the examples are apparently tough and hectic, which provides challenging situations and huge work load. They also demands extensive attention and time devotion to an employee’s work life. In general, most of the employees would face exhaustion and burn out while working in this schedule (Burke & MacDermid, 1999), but these individuals mentioned in the examples, are driven by challenge and they are motivated by high target fulfilment. All of them work in respectable and well renowned companies and in reputable positions. Although, they have very little time for personal life, and their work-life balance is reduced to a minimum, they enjoy their work life more than their personal life. These individuals are all self-motivated; they are driven by tough challenges and high achievement of success. According to Douglas, and Morris (2006), most workaholic people work for personal desire, they are rarely driven by the future outcome, rather what push es them is the need to complete their task and reach their goal. They all push themselves out of their comfort zone, to achieve what most of the people cannot. Some of the jobs allow the employees to travel all around the world, which is preferred by a workaholic employee, but is seen as a hectic scheduled job by an average one. According to Koà §oglu, Gà ¼rkan, and Aktas (2014) challenging workload is one of the factors of job satisfaction. Workload can be overwhelming to employees if it exceeds the employees’ working ability. Eventually, it causes job dissatisfaction and psychological withdrawal from the job. On the other hand, too little work load can cause job dissatisfaction too, because the employee eventually feels frustrated and their morale goes down (Koà §oglu,

Instructional adjustment Essay Example for Free

Instructional adjustment Essay Introduction: A survey polled some 770 students and asked how much effort they felt they were putting into their schoolwork. To everyone’s surprise, the students with low grades thought they worked as hard as anybody! Yet when their study habits were examined, it was discovered that they actually did far less homework than their high-achieving schoolmates (Awake, 7). It appears that their teachers were at least partially responsible for this delusion. Perhaps they felt that these low-achieving children were not capable of much to begin with. Or they may have felt that merely being warm and friendly toward them was enough to motivate them to excel. Whatever the case, it seems that the teachers highly praised the students’ most minimal efforts. Passing grades were routinely given out merely for attending class. The children were made to feel that they already worked as hard as they could. Thus they did little to improve. This is among the problems occurring in schools and other training institutes for children. According to surveys, there should be more creative and interesting strategical approaches that They polled some 770 students and asked how much effort they felt they were putting into their schoolwork. In short, both groups of students should be able to be catered by the strategies to be applied. In this paper, a wide array of choices and steps shall be discussed to answer the said problem in teaching and training. The Teaching Strategies: Every study time must include reviews of the past learned lessons. This will help the students remember the lessons that were learned during the last meeting for the class and thus refresh in their memories the overall content of the subject. After the review, the presentation of the new concept must be performed by the teacher. The following are some examples of being able to do so in such an interesting way for both the slow and advance learners: †¢ Presentation using illustrative drawings-children and students of all ages often enjoy the drawings shown to introduce a certain topic. †¢ Usage of Mind games- as an introduction let the students think in a fun way. †¢ Introduction using a story- this will help the students think and analyze what is going to be discussed. Aside from this, the students’ attention will be caught by the story. †¢ Usage of Media- there available VCDs and DVDs provided for several subjects in school. This could help the students enjoy while they learn. †¢ Usage of technology- computer presentations and other presentations using technology inventions could help the learners find a way to understand the topic in their own pace. †¢ Relate the topic to reality-Usually the certain topics discussed in school are based in real life †¢ Use key words to introduce the topic-Usually one word keys that introduce a whole topic helps the students remember the lessons easier. †¢ Use open-ended questions- letting the students think will help them comprehend better on what is being discussed in class. †¢ Encouraging a role play activity- this will allow the students have a refreshing start for a new lesson †¢ Giving handouts about the new lesson After introducing the lesson for the day a guided procedure must follow through to help the students go along with the topic for the day. Here are some hints in guiding students effectively: †¢ Using a diagram- an illustrated and colorful diagram could help the students visualize the activities †¢ Use guided questions- give the students the chance to decide on how they are going to go about the lesson. †¢ Go beyond the book- do not just use the book as a source, instead let the students prepare their own sources and let them share it in class for classroom participation. †¢ Prepare handouts Aside from classroom discussions though, students who are assumed to be slow learners must be encouraged to do independent practices which may include the following: †¢ Remedial Classes †¢ Extra Homework Activities †¢ Extended class sessions for a group of students †¢ Students assist students program †¢ Extra project for make-up home works for classroom activities which they could not cope up with. †¢ Encourage home reading activities †¢ Making considerable time adjustments for a student’s completion of school requirements With all these guidelines, a student is supposed to comply with the teacher’s strategies and if that doesnn’t happen, some interventions might be necessary for the teacher to use like: †¢ Finding the root cause of the problem †¢ Identifying the student’s learning stage or learning pace †¢ Match students to appropeiate levels of learning †¢ Adopt evidence-based intervention strategies †¢ Require active response †¢ Review, review. Review. If all this things shall be considered in teaching a group of students comprising of both the advance and the slow learners, agreeable results are to be gained since all these are already proven effective by many teachers worldwide. Strategic Marketing Management of Nestle Analysis

Strategic Marketing Management of Nestle Analysis The purpose of this assignment is to evaluate the impact of organizational strategy in developing a marketing plan and to evaluate the component parts of a marketing plan. For this purpose a marketing plan for Nestle pure life (Bottled water by Nestle in Pakistan) is developed for understanding different components of marketing plan. Impact of Organizational Strategy on Market Plan It is very critical in todays highly competitive market to develop and adapt an approach that supports the organizations resources and nature of business. The strategy should be developed by keeping in mind all the available resources and should be so powerful that the product or service can outsell the competition. If the available resources are not considered while designing the strategies then it is quite possible that those resources will not be able to convert the inflow of customers in to profitable long term relationship. So it is very important to have a strategy that supports the resources and the expertise to implement it. Different organizations have different types of strategies, however most common are five significant strategies that affect the marketing plan of the organizations. Market Leadership Strategy If an organization has to maintain the position of market leadership then the marketing plan will be focused towards two main factors. First is to increase the market share and second is to keep intact the existing customers by providing them value to their money they are spending to buy the companys products of services (Kathryn, 2010). Market share can be increased by finding the new markets in other demographics or expanding in to the new locations. Another way to increase the market share is to attach the competitors market share through variety of strategies. Offering several value added services helps to keep the customers intact with the organization. In this case the marketing plan will focus towards the augmented features of the product or service. Market Challenger Strategy If the organizations strategy is to be a market challenger then the marketing plan will be focused towards the small unmet needs of the customers. The marketing plan will be very aggressive and the focus will be to increase the market share in small chunks and to target the customers by promoting those features which are fulfilling their unmet needs (Kathryn, 2010). Market Follower Strategy If an organization is following market follower strategy then the marketing plan will not be very aggressive (Dibb, 2001). The markets are already identified and researched by the competitors and the market plan will target those weak points which are left by the competitors and the better solutions will be provided to the customers. Market Niche Strategy Organizations can also divide the market in to small segments/chunks and prepare the marketing plan for each segment. This allows the organization to influence the customers more deeply with the marketing campaign as the focus is on a particular segment. For instance the marketing plan of a cosmetic can target the women between the age limit of 20-25 years. Alliance Strategy The organization can also form strategic alliances to increase the impact of the marketing plan. The strategic alliances enables the organization to offer new products or value added services to the customers and the marketing plan focuses on promoting the benefits of the alliance of the organization to the customers (Kotler, 2003). Component Parts of a Marketing Plan Marketing plan refers to that document which outlines the actions and details that are required to be undertaken in order to achieve one or more marketing objectives. Marketing plan can either be for a brand, or for a product or service or even for a whole product line. Marketing plans can cover the marketing objectives of up to five years and the marketing objectives are aligned with the organizational objectives. Following are the main components of a marketing plan. Situation Analysis Situation analysis is very important and initial part for developing a marketing plan. It explains and clarifies the current position of the organization in the market. This analysis should be done fairly by the organization as exaggerating the current market position in front of the management will ultimately give a failure at the end of marketing campaign. Situation Analysis involves external, internal and customers analysis (Ward, 2010). SWOT Analysis SWOT analysis is another major part of the marketing plan as it identifies the strengths and weaknesses of the organization and the opportunities and threats for the organization. It also helps to determine the current state of the organization, but it also adds the opportunities and threats to the organization which can be focused in the marketing plan (Dibb, 2001). Marketing Goals and Objectives After SWOT analysis the organization is in much better position to set the marketing objectives and goals. Goals are the overall accomplishment that is likely to be achieved by the organization and the objectives are the benchmarks which enables the organization to meet those goals (Ward, 2010). It is very important the goals and objectives should be realistic and should reflect the mission of the company. Marketing Strategies In marketing strategy the marketing mix and the target market is discussed. Product features, placement, pricing and distribution are the four main aspects of any product or service and the marketing plan contains the blend of these strategies and marketing strategy is designed keeping in mind the target audience (Kotler, 2003). Implementation Implementation planning is another important part of the marketing plan. At first it is described that what is required to be done internally in order to get success such as employee training, employees empowerment etc. for the success of market plan. Secondly, a month-by-month marketing calendar is prepared that guides the marketing activities. Evaluation and Control Evaluating the marketing plan is very important, as this helps to identify that what is to be done in future and what not. If the marketing plan is of 3 to 5 years then periodic evaluation is necessary as changing market conditions can be costly while sticking with the old techniques. Evaluation also helps to identify whether the plan is implemented properly. Threat to Nestle Pure Life Different threats and weaknesses for Nestle pure life are identified in the marketing plan, however, the most critical threat and weakness for the product is the current economic and political condition in Pakistan. This threat is for every business operating in Pakistan, however, Nestle pure life has direct affect to the economic situation of Pakistan. As the target market of Nestle pure life is upper and middle class and due to increasing ratio of unemployment and poverty the people are moving towards the usage of simple or boiled water as spending Rs. 35 for water is becoming unaffordable for majority of middle class people. Moreover, there are several other local brands which are not up to the mark, but they sell the brand to the local market by assuring them about the quality and purity which decreases the demand of high quality product like Nestle pure life. This causes a serious threat to the brand in near future (Rosemann, 2005). No doubt Nestle pure life is currently a dominant leader in Pakistan market in Mineral water Industry. Nestle Pure Life is currently dominating more than 80% of bottled water market share (Rosemann, 2005), when Nestle Pure Life start its bottled water business in Pakistan way back in 1998 on that particular time AVA was the major competitor in the market, but after a time period of one year AVA was acquired by the Nestle Pure Life and now currently AVA is in the business of bulk water. There are different brands of bottled mineral water but the most famous are: Nestle Pure Life Aquafina Sufi Kinley For manufacturing and distributing mineral water in Pakistan the company has to obtain licenses and have to follow the rules and regulations of Pakistan Standard Quality Control Authority (PSQCA). Particular in Lahore, gourmet is giving a very tough competition to Nestle pure life as their price is less than Nestle pure life. Moreover, gourmet is approaching the other cities and rural areas of the country and possibly will emerge as a strong competitor of Nestle pure life in near future. There are also other competitors found within a local market which include Sparklet, Acqacare, Pure, Aafi, Oura, Aabshar and many other local brands, but their market share is very low as compare to the Nestle Pure Life. Macro Environmental Analysis The Macro-Environment forces, which include political, Social-Cultural and Economic forces, affect the overall performance of the brand (Kotler, 2003). Political instability always matter in a market situation, there should be an investment security. PSQCA has approved Nestle Pure Life; Nestle Pure Life is also promoting the culture of humanity and higher labor as many people from Pakistan have got job in the different parts of the world in Nestle Food. No doubt Nestle Pure Life is a market leader, but some of the government policies affecting the marketing strategy of Nestle Pure Life as government closed many several companies by saying that they are producing un approved water for the people of Pakistan in the name of mineral water, but such kind of situation doesnt affect any marketing strategy of Nestle Pure Life because it is producing a water according to the standard which is approved by World Health Organization WHO. As far as Social and Cultural forces are concerned now the people are realizing the need of bottled water especially in cities, as they are more health conscious as compare to the people of rural areas. Wrong Market Information In Pakistani markets the availability of complete and authentic data is very difficult. There are very few government sources which provide the market information, but those also cannot be relied upon as the data collection is not known. In case the data or information taken from the governmental sources is found to be incorrect then the company will rely upon the data collected from surveys and past trends. Outsourcing If the internal resources are not able to meet the growing demand of the customers then the production will be outsourced, but the quality will not be sacrificed in any case. Mismatch of Projections If there is a mismatch of the financial projection then the efforts will be re-doubled and the focus will be on direct marketing. However, the other marketing expenses will not be cut down as it is very necessary to keep conveying the message across the target audience. The Health Insurance Portability and Accountability Act (HIPAA) Essay

Health Insurance Portability and Accountability Act The Health Insurance Portability and Accountability Act, most commonly known by its initials HIPAA, was enacted by Congress then signed by President Bill Clinton on August 21, 1996. This act was put into place in order to regulate the privacy of patient health information, and as an effort to lower the cost of health care, shape the many pieces of our complicated healthcare system. This act also protects individuals from losing their health insurance if they lose their employment or choose to switch employers. . Before HIPAA there was no standard or consistency for the enforcement of the privacy for patients and the rules and regulations varied by state and organizations. HIPAA virtually affects everybody within the healthcare field including but not limited to patients, providers, payers and intermediaries. Although there are many parts of the HIPAA act, for the purposes of this paper we are going to focus on the two main sections and the four objectives of HIPAA, a which are to improve the portability (the capability of transferring from one employee to another) of health insurance, combat fraud, abuse, and waste in health insurance, to promote the expanded use of medical savings accounts, and to simplify the administration of health insurance. Title I of the HIPAA act refers to mostly the group health plans and the restrictions they can place upon the policy holder. In layman’s terms, HIPAA makes sure through Title I, that a third party cannot deny you coverage due to the loss or change in employment. On top of the basic clause, a group plan cannot deny coverage based on your health status, which includes medical history, genetic information, or disabilities. Ti... ...proactive. With the way that HIPAA was drafted, then add the possible penalties for violators, lead physicians and medical facilities to withold information from individuals who have a right to it. After reviewing the rules of the HIPAA, the legislation found health care providers were unsure of their legal privacy responsibilities and often responded with an overly guarded approach to disclosing information. To date these rules are still confusing and need to made clearer. References Medical Law and Ethics 4th edition, Bonnie F. The Defeat of Ethiopia Essay -- African History

In the beginning of the 20th century, all of Africa was in European hands except for just one country. Despite all the factors against this one country, Ethiopia, in1896 they successfully defended themselves from the Italians in the Battle of Adwa. Unfortunately, when the Italians invaded a second time in 1935, the Ethiopians were not so successful. How come the Ethiopians were defeated when not 50 years earlier they were victorious? Was the advance in technology to much for the Ethiopians to combat or was it the lack of good leadership that they once had in the years leading up to the second invasion. I believe that due to the lack of good leadership before and during the second Italian invasion attributed to the defeat of Ethiopia, rather than their technological deficiencies. To first understand the loss in the second war we must first briefly look at their victory in the first war. In this conflict Ethiopia defeated the Italians because their leaders made all the right choices before and during the war. It started with Emperor Tewodros II, who â€Å"reunified the Ethiopia under a single emperor†. Before that Ethiopia was in great disarray, with many different kings and warlords ruled different parts of Ethiopia. This was a crucial step in defeating the Italian because without the full cooperation of all the Ethiopian warlords, than the Italian military would have easily defeated the fragmented Ethiopian states. Another crucial decision that Tewodros II made was to modernize the Ethiopian military with firearms. He learned this lesson harshly after a tough defeat from the modern equipped Egyptian army and from this experience he used it to better his empire. With just these two simple improvements Ethiopia was now in ... ...talian bullets ever could. Even in our time, the most modern army like the United States is not assured victory against a less advanced foe like the Taliban. In the end, it all comes down to the soldiers training, and the leadership of their superiors. WORKS CITED Del Boca, Angelo. Guerra d'Abissinia. Translated by Giangiacomo Feltrinelli. Memorandum Mandatory Use of Turkish Language Essay

This Memorandum aims to provide brief information on (i) provisions and restrictions imposed by the Law on Mandatory Use of Turkish Language by Economic Enterprises numbered 805 and dated 10 April 1926 (the â€Å"Law No. 805†) on Turkish and foreign enterprises; (ii) consequences of non-compliance with the Law No. 805; and (iii) application of the good faith principle in the light of the precedents of the Turkish Supreme Court of Appeals (the â€Å"Court of Appeals†). A. SCOPE OF THE LAW NO. 805 The Law No. 805 is applicable to all Turkish and foreign enterprises with respect to transactions listed in Articles 1 and 2 of the Law No. 805; however, application of the Law No. 805 differs depending on the nationality of the enterprise. 1. TurkÄ ±sh EnterprÄ ±ses In accordance with Article 1 of the Law No. 805, â€Å"Any type of companies and enterprises which have Turkish nationality shall use Turkish language in all kinds of transactions, agreements, correspondences, accounts and books within Turkey†. According to Article 1 of the Law No.805, each company and enterprise a the Turkish nationality is obliged to keep any kind of transaction, records and books and execute all agreements and make all communications with each other in Turkish language within the territory of Turkey. Accordingly, the only exclusion for the obligation of the use of Turkish language in transactions and communications of Turkish companies and enterprises is the case where such transactions and communications are executed/performed outside the territory of Turkey. In that respect, it is clear that an agreement to be executed between two or more Turkish companies should be prepared and signed in Turkish language, or if it is preferred to be executed in a foreign language, to be accompanied with a Turkish version which shall prevail in the event of discrepancy. There are several court decisions in this respect. In one of its judgments, the Court of Appeals has upheld that the parties, in the text of the agreement may refer to non-Turkish (international) terms and/ or clauses, only if (i) these terms cannot be replaced by a counterpart in Turkish; and (ii) the parties are obliged to include such terms in the agreement. However, it has also underlined by the Court of Appeals that this rule is valid only for terms and expressions either with no counterpart in Turkish or which cannot be written in Turkish. Similarly, in a later decision, the Court of Appeals has ruled that if the parties are both Turkish then all agreements must be executed in Turkish; although international terms and expressions may be incorporated into a Turkish agreement as a special condition. In this decision, the Court of Appeals has not accepted the usage of a maturity clause which was drafted in English language in an agreement executed in Turkish language since such maturity clause could easily be drafted in Turkish language as well. 2. ForeÄ ±gn enterprÄ ±ses In accordance with Article 2 of the Law No. 805, â€Å"This obligation applies to foreign companies and enterprises only in their communications, transactions and relations with the Turkish institutions and persons and for the documents, books and records which must be submitted to governmental offices and government officers.† Pursuant to Turkish legislation, a foreign enterprise is a duly incorporated legal entity that has its registered office outside of Turkey. For foreign enterprises, as stated above, the requirement of Turkish language usage is limited only to (i) transactions, correspondences and communications with persons and legal entities subject to Turkish laws; and (ii) documents, books and records which will be presented to Turkish authorities. In contrast with Article 1 of Law No. 805, Article 2 of the Law No. 805 has a narrower a scope of obligation to use Turkish language. The wording â€Å"agreement† is willingly not stated in Article 2 on purpose. In other words, the Law No. 805 does not specifically refer to â€Å"agreements† under the provision concerning foreign entities. This omission indicates that the Law No. 805 allows the execution of an agreement between a foreign entity and a Turkish entity in a foreign language. There are several court decisions with respect to Article 2 of the Law No. 805. In a decision by the 11th Circuit of the Court of Appeals, the Court of Appeals has upheld that all accounts and books have to be in Turkish language, when submitted to the relevant Turkish authorities. Otherwise, they do not have any validity before Turkish courts. The Court of Appeals has come to a similar conclusion summarizing that Turkish enterprises may enter into agreements with foreign enterprises in any language since Article 2 of the Law No. 805 specifically lists instances where foreign enterprises are prohibited from using a foreign language and this list does not include agreements. Accordingly, the Court of Appeals has concluded that agreements may be executed in any foreign language, where one of the parties is a foreign enterprise and the other is Turkish. According to this decision, an agreement executed in a foreign language between a foreign company and a Turkish company is valid and binding on the parties pursuant to and under Turkish laws. However, under Article 4 of the Law No.805, the parties are compelled to use Turkish language in all correspondences with respect to the agreement, although the agreement is allowed to be drafted in a foreign language. B. CONSEQUENCES OF NON-COMPLIANCE WITH THE LAW NO. 805 Pursuant to Article 7 of the Law No. 805, any party violating the related provisions is imposed to a judicial fine of at least 100 days. The Turkish Penal Code numbered 5237 has regulated the judicial fine provisions and accordingly the judicial fine for one day shall be determined between TL 20 – TL 100 depending on (i) severity of violation; (ii) specific and economic conditions of persons; and (iii) discretion of judges. C. GOOD FAITH PRINCIPLE Pursuant to Article 2 of the Turkish Civil Code, raising a good faith claim is possible regarding the conflicts in an agreement. While deciding on the validity of the good faith claims, the determination shall be made on a case-to-case basis. In terms of disputes regarding non-compliance with the Law No. 805, there is not a definite provision for the application of the good faith principle and we have not come across any judgment of the Court of Appeals regarding the good faith claims has raised with respect to the application of the Law No. 805. However, with respect to the general provisions regarding the good faith claims, by analogy, the following solution may apply to conflicts on the mandatory use of Turkish language in agreements. In the event that the parties have carried out their performances to the fullest extent, considering that the agreement is valid, the agreement, itself, should be considered valid, as well. The Court of Appeals, in one of its judgments, has stated that if parties have carried out their obligations under a contract for a long time, it would be a violation of the good faith principles to claim that the related contract is invalid. Similarly, the Assembly of Civil Chambers of the Court of Appeals has ruled in a former decision that the right to raise a good faith claim is restricted when the party raising the claim is acting against the good faith principle. Although the aforementioned judgment does not directly refer to a dispute under the Law No. 805, the following conclusion could be drawn: when one or both of the parties is awaring (or shall be aware) of the mandatory use of Turkish language requirement and the aware party (or parties) disregards this rule on purpose, they should not be able to rely on a good faith claim regarding the language of the agreement.

What send packing Lauras company do to castrate its emotional climate? 1. What factors do you calculate tell on some judicatures ineffective at managing emotions? There atomic number 18 umpteen factors that irritate organizations ineffective with managing emotions in the workplace. Human beings difficult speculateing is one of the factors that claim the organizations fractious to manage the emotions. E very(prenominal) person is contrastive and has his/her own emotions (Robbins 2013, p. 160). Each person whitethorn not act in the corresponding way in a analogous situation due to cultural stage setting (Robbins 2013, p. 162). Therefore, organizations face difficulties when they are transaction with their employees emotions. This is b ecoming a problem when the organization is very large and contains many employees from opposite background. In addition, some periods the top theatre directors of the organization offernot retard their own emotions as well. On the other hand, organizations are unable to relate to their employees, and their lack of perpetual contact with their staff can be other factor. By holding strong connections with hands, organizations can ensure that emotions and moods are up-beat and energetic. When I worked at IBM, they would call in severally employee individually to the managers stead every month for a sign in appointment. This is where managers would get very friendly with employees so that we would tell them what was going good, what was going bad, and our thoughts on the current tasks at hand.I learned that the staff would look forward to these monthly meetings and would pass along a lot of useful instruction to the managers during this time. Even though organizations want employees to pass their true emotions, I dont think crying at work is acceptable. This is an emotion that should be unlessd for mob due to the fact that it could hurt your hear and current position at work. When I say crying at work is unacceptable, I dont entertain that employees should bottle up their emotions. There is a time and place for everything and I believe you should save the crying for home and confront your manager alone in a maestro way once your 1. What factors do you think make some organizations ineffective at managing emotions? Firstly, I think that the complex human race thinking is one of the factors that make the organizations unenviable to manage the emotions. Every person has his or her own emotions. Although in a uniform situation, they may not act in the same way. Thus, the organizations face difficulties when they are dealing with their employees. This problem is even becoming worse when the organization is very large and contains many employees from different background. Furthermore, the authority of an organization sometimes finds out they themselves cannot control their own emotions as well. Besides, due to the business culture and etiquette which are still remain poorly in some of the organizations, it becomes a problem for the organizations to manage the emotions effectively. Some of the organizations have not practiced the suitable business culture. For example, they will yell and shout at the employees when things go wrong just like the second case mentioned. This shows that some of the organizations still do not concern to manage the emotions effectively. Moreover, emotions are self-regulating physiological responses to the environment. It will be very unvoiced for one to control his or her emotions by hiding their true feelings at bottom their heart. It revealed automatically. Even people that are act to cover their true emotions can be discovered from their facial expression.Th us, this is not the severance that the organisations cannot manage the emotions effectively. This is because it is not an easy work to control the emotions of whole organisations. 2. Do you think the strategic use and display of emotions serve to protect employees, or does covering your true emotions at work lead to more problems than it solves? By covering ones emotions can sometimes ensure a work to be done perfectly.
